1. Acceptance of Terms

By accessing or using the Mystery Trader website and services (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes.

2. Age Requirements and Eligibility

2.1 Minimum Age

You must meet the following age requirements to use this Service:

• United States: You must be at least 13 years of age.
• Canada (except Quebec): You must be at least 13 years of age.
• Quebec, Canada: You must be at least 14 years of age.
• Other jurisdictions: You must meet the minimum age required by applicable law in your jurisdiction, but in no case less than 13 years of age.

2.2 Parental Consent

If you are under the age of majority in your jurisdiction (18 in most US states, 18 or 19 in Canadian provinces), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2.3 Account Responsibility

If you are a parent or guardian and you provide consent for your child to use this Service, you agree to be bound by these Terms on behalf of your child and are responsible for your child's activity on the Service.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate and current
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

4. User Conduct

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Post false, misleading, or fraudulent content

• Attempt to deceive other users in trades
• Use the Service for any illegal purpose
• Interfere with the proper functioning of the Service
• Attempt to gain unauthorized access to other accounts or systems
• Use automated means to access or collect data from the Service without permission
• Post content that is obscene, offensive, or inappropriate

5. Trading and Transactions

5.1 User-to-User Transactions

The Service facilitates trades between users. We are not a party to any trade and do not guarantee the quality, safety, or legality of any collectibles traded through the Service.

5.2 No Warranty

We do not verify the accuracy of listings, the quality or condition of collectibles, or the identity of users. All trades are conducted at your own risk.

5.3 Disputes

Users are solely responsible for resolving any disputes arising from trades. We are not obligated to mediate or resolve disputes between users but may do so at our discretion.

6. User Content

6.1 Your Content

You retain ownership of content you submit to the Service (photos, descriptions, messages). However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, distribute, and display that content in connection with the Service and our business operations.

6.2 Content Standards

You are solely responsible for the content you post. Content must not violate these Terms, infringe on third-party rights, or be illegal, harmful, or objectionable.

6.3 Content Removal

We reserve the right to remove any content that violates these Terms or that we deem inappropriate at our sole discretion.

7. Intellectual Property

The Service and its original content (excluding user content), features, and functionality are owned by Mystery Trader and are protected by copyright, trademark, and other intellectual property laws.

References to collectible products, manufacturers (such as Bauer and CCM), and related trademarks are for identification purposes only and do not imply endorsement or affiliation.

8. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection, use, and sharing of your information as described in the Privacy Policy, including the potential sale of certain data.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MYSTERY TRADER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

In no event shall our total liability exceed the greater of $100 USD or the amount you have paid us in the past twelve months.

11. Indemnification

You agree to indemnify and hold harmless Mystery Trader and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in King County, Washington.

13. Dispute Resolution

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved informally, you agree that any legal action shall be filed in the courts specified in Section 12.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Mystery Trader regarding your use of the Service and supersede all prior agreements and understandings.
